WHAT HAPPENS WHEN SOMEONE IS DETAINED BY THE INS?
They are detained in a detention center to await a hearing to see if they can remain in the United States.

The INS judge will in most cases set a bond amount, allowing the detainee to be released once the bond is posted.

WHAT IS AN IMMIGRATION BAIL BOND?
Most people have never heard of an immigration bail bond. An immigration bail bond is for immigrants who have been arrested by the Immigration and Naturalization Service for any number of reasons.
 
An immigration bail bond is a guarantee to the court that the detainee will show up to all appearances as required by the Immigration Court. If he/she fails to appear for any court appearance the bond is forfeited and the bonding company will have to pay the amount of the bond to the court.

The person who signs and pays the bond guarantees to the court that the immigrant  will appear to all court dates. 


HOW DO I POST AN IMMIGRATION BOND?

A cash bond may be posted directly with INS.
 if the bond is $10,000.00 someone in the detainee's behalf can post $10,000.00  in cash.

Once the Case is over (about 1  year or more) the money will be returned to the same person that posted the bond. (could take up to 2 years to get the money back). 

Or you can use an immigration bondsman who will post the bond for a nonrefundable
fee.

POSTING A BOND  DOES NOT MEAN THEY WON'T BE  DEPORTED!

posting a bond allows the detainee to be released from the INS. It will allow him/her to return to his free life and prepare a case to try to stay in the United States.

WHAT HAPPENS IF THE DETAINEE DOES NOT POST BOND?
The detainee will remain incarcerated untill the matter is heard by an INS judge.
Making bond is the better way becouse they can be free and work on the case more easily.

WHAT IS REQUIRED TO POST AN IMMIGRATION BOND?

The bondsman charges a fee to post the immigration bond; this fee may vary from
bondsman to bondsman. The bondsman will require a cosigner, to sign for the bond, and in some cases collateral is required. The
cosigner is responcible to reimburse the bondsman for a forfeited bond..
